Childhood friends who wanted to start a metal band, Xmuzik is a Louisiana electronica music & poetry group based in the Bible Belt that mixes many electronic & contemporary music styles ranging from electronica to black metal to folk to country. They differentiate themselves through the use of highly experimental yet accessable electronic music mixed with poetry & prose made mostly with cheap computers & software.

Influenced by such groups as Acid Bath , The Doors , & the electronic artists that were
promoted in and around the New Orleans area by the Outlaw Donnie Disco of the Freebass Society.
Jazon got the idea that maybe he & John should scrap the whole metal band idea & try to use
some of the new electronic equipment & software that was beginning to come out in the 90's after
finding a party of Donnie's Online.

They have 1 full length net label album to their credit " The Streets Of A New World Order " that is shared freely throughout the internet & electronic underground. In no way are they affiliated with The RIAA.

The music industry dropped 751 copyright-infringement lawsuits in the mail today, bringing the total number of legal actions this year against alleged peer-to-peer (P2P) infringers to more than 7,000.

The John Doe lawsuits filed Thursday cite individuals for illegally distributing copyrighted music on the Internet through P2P services, such as LimeWire and Kazaa. In addition to the John Doe suits, the major music labels also filed lawsuits against 105 named defendants.

"At stake is the music industry's ability to invest in the next generation of music and a chance for legal online music services to flourish," Cary Sherman, president of the Recording Industry Association of America (RIAA), said in a statement.

The latest batch of RIAA lawsuits comes a day after market research firm NPD Group issued numbers claiming illegal downloads have fallen 11 percent since the Supreme Court ruled in June that Grokster and other P2P companies were operating illegal businesses.

Those numbers, however, were disputed by Eric Garland, CEO of media measurement firm BigChampagne.

"In fact, in every month since Grokster, P2P activity is actually higher than it was in May/June, or at any other point," he said in an e-mail to internetnews.com.

Whether the amount of illegal P2P downloading is up or down, the RIAA pledged to continue its lawsuits.

"We must do everything to protect the integrity of the marketplace. That means educating fans about steering clear of pirated products and continuing to enforce our rights to send a clear message that stealing music will bring consequences," Sherman said.

The John Doe lawsuits included students at Drexel University, Harvard and the University of Southern California.

New Hack Could Create Problems for RIAA, MPAA

New hacker attacks appear all the time, but a recent exploit is of particular concern to the movie and record industries. The newly-discovered attack takes advantage of a rootkit called lockx.exe ― which was previously delivered to millions of PCs by the SDbot worm ― to covertly download movie files on a victim’s machine. Here, the lockx.exe rootkit is used to help plant corrupted copies of BitTorrent that automatically download the movie Mr. Bean to infected computers. The exploit, discovered by security firm FaceTime Communications, has been linked to a Middle East hacker group with a network of zombie machines that spread the attacks. It is unclear what the group’s motive is, but FaceTime suspects it is a test for a much more ambitious application.

A widespread dissemination of the hack would pose number of problems for both the MPAA and RIAA, as it sets up the scenario where attack victims could be falsely accused of file-sharing and sued. Worse, it could set up a “Virus Defense” in the US, in which anyone who is sued can simply blame all illicit download activities on the exploit. Sound far-fetched? The Virus Defense already stands as precedent in Great Britain, where it was successfully applied in a pedophilia case. The content industries could try to undermine this defense by attempting to hold file-sharers responsible for the security of their computers, just as the RIAA has attempted to hold parents responsible for the actions of their children. But that would be a dangerous precedent to set, particularly when Sony BMG is facing several lawsuits for a rootkit of its own.

AUSTIN, Texas (AP) -- Texas Attorney General Greg Abbott expanded his lawsuit against Sony BMG Music Entertainment on Wednesday, alleging that a second form of anti-piracy technology used by the label violates the state's spyware and deceptive trade practices laws.

Abbott sued Sony BMG in November, saying the world's second-largest music label surreptitiously included spyware on millions of CDs through technology known as XCP. That technology, included on 52 Sony BMG titles, could leave computers vulnerable to hackers, he said.

The new allegations involve an unrelated CD copy-protection technology known as MediaMax, which was loaded on 27 Sony BMG titles, including Alicia Keys' "Unplugged" and Cassidy's "I'm a Hustla."

"We keep discovering additional methods Sony used to deceive Texas consumers who thought they were simply buying music," Abbott said in a statement.

BMG officials said in a statement that they are working with Abbott's office and believe they can prove they have responded appropriately to his concerns.

"The security issues with MediaMax are not uncommon and are completely addressed by a software update which we already have made available, as is standard practice when problems with consumer software are identified," the statement said.

Anti-piracy technology restricts the number of times a single disc can be copied and can make it extremely inconvenient to transfer songs into the format used by Apple Computer Inc.'s iPods.

The MediaMax technology limits how many backup copies can be made of the CD on a computer or how the tracks can be shared with other users.

The Electronic Frontier Foundation, an online civil liberty group, discovered that, like XCP, MediaMax could allow an outsider to gain unauthorized access to a computer. Two weeks ago, Sony BMG began urging consumers to download a patch that would plug the potential security breach. About 5.7 million CDs were shipped with the software.

Abbott said MediaMax violates Texas law because some versions secretly install files when the CD is inserted into a computer, before the consumer has a chance to accept or decline a license agreement. The files can lead to the security breach.

Sony BMG misleads consumers by saying no files will be installed if the agreement is rejected, Abbott said, when, in reality, the installation already has occurred. It is difficult for consumers to remove the files, he added.

Sony BMG, which rejects the spyware description, said it has provided consumers with a one-click "uninstall" application that lets them remove MediaMax from their computers.

The label recalled the discs with XCP in November and released a way to remove the files from users' computers. Some 4.7 million CDs had been made with the technology and 2.1 million had been sold.

The state can recover up to $100,000 in damages for each violation of the spyware law and $20,000 in damages for each violation of the deceptive trade practices law. Individuals whose computers were affected by the anti-piracy technology also can recover damages.

Abbott has said that any money recovered by the state would go to Texas' general revenue fund.

Sony BMG is a joint venture of Sony Corp. and Bertelsmann AG.

Confessions of a cut & paste artist.

When I was 13, in 1961, I surreptitiously purchased an anthology of Beat writing - sensing, correctly, that my mother wouldn't approve.

Immediately, and to my very great excitement, I discovered Allen Ginsberg, Jack Kerouac, and one William S. Burroughs - author of something called Naked Lunch, excerpted there in all its coruscating brilliance.

Burroughs was then as radical a literary man as the world had to offer, and in my opinion, he still holds the title. Nothing, in all my experience of literature since, has ever been quite as remarkable for me, and nothing has ever had as strong an effect on my sense of the sheer possibilities of writing.

Later, attempting to understand this impact, I discovered that Burroughs had incorporated snippets of other writers' texts into his work, an action I knew my teachers would have called plagiarism. Some of these borrowings had been lifted from American science fiction of the '40s and '50s, adding a secondary shock of recognition for me.

By then I knew that this "cut-up method," as Burroughs called it, was central to whatever it was he thought he was doing, and that he quite literally believed it to be akin to magic. When he wrote about his process, the hairs on my neck stood up, so palpable was the excitement. Experiments with audiotape inspired him in a similar vein: "God's little toy," his friend Brion Gysin called their reel-to-reel machine.

Sampling. Burroughs was interrogating the universe with scissors and a paste pot, and the least imitative of authors was no plagiarist at all.

Some 20 years later, when our paths finally crossed, I asked Burroughs whether he was writing on a computer yet. "What would I want a computer for?" he asked, with evident distaste. "I have a typewriter."

But I already knew that word processing was another of God's little toys, and that the scissors and paste pot were always there for me, on the desktop of my Apple IIc. Burroughs' methods, which had also worked for Picasso, Duchamp, and Godard, were built into the technology through which I now composed my own narratives. Everything I wrote, I believed instinctively, was to some extent collage. Meaning, ultimately, seemed a matter of adjacent data.

Thereafter, exploring possibilities of (so-called) cyberspace, I littered my narratives with references to one sort or another of collage: the AI in Count Zero that emulates Joseph Cornell, the assemblage environment constructed on the Bay Bridge in Virtual Light.

Meanwhile, in the early '70s in Jamaica, King Tubby and Lee "Scratch" Perry, great visionaries, were deconstructing recorded music. Using astonishingly primitive predigital hardware, they created what they called versions. The recombinant nature of their means of production quickly spread to DJs in New York and London.

Our culture no longer bothers to use words like appropriation or borrowing to describe those very activities. Today's audience isn't listening at all - it's participating. Indeed, audience is as antique a term as record, the one archaically passive, the other archaically physical. The record, not the remix, is the anomaly today. The remix is the very nature of the digital.

Today, an endless, recombinant, and fundamentally social process generates countless hours of creative product (another antique term?). To say that this poses a threat to the record industry is simply comic. The record industry, though it may not know it yet, has gone the way of the record. Instead, the recombinant (the bootleg, the remix, the mash-up) has become the characteristic pivot at the turn of our two centuries.

We live at a peculiar juncture, one in which the record (an object) and the recombinant (a process) still, however briefly, coexist. But there seems little doubt as to the direction things are going. The recombinant is manifest in forms as diverse as Alan Moore's graphic novel The League of Extraordinary Gentlemen, machinima generated with game engines (Quake, Doom, Halo), the whole metastasized library of Dean Scream remixes, genre-warping fan fiction from the universes of Star Trek or Buffy or (more satisfying by far) both at once, the JarJar-less Phantom Edit (sound of an audience voting with its fingers), brand-hybrid athletic shoes, gleefully transgressive logo jumping, and products like Kubrick figures, those Japanese collectibles that slyly masquerade as soulless corporate units yet are rescued from anonymity by the application of a thoughtfully aggressive "custom" paint job.

We seldom legislate new technologies into being. They emerge, and we plunge with them into whatever vortices of change they generate. We legislate after the fact, in a perpetual game of catch-up, as best we can, while our new technologies redefine us - as surely and perhaps as terribly as we've been redefined by broadcast television.

"Who owns the words?" asked a disembodied but very persistent voice throughout much of Burroughs' work. Who does own them now? Who owns the music and the rest of our culture? We do. All of us.

Though not all of us know it - yet.

Death of an American City

We are about to lose New Orleans. Whether it is a conscious plan to let the city rot until no one is willing to move back or honest paralysis over difficult questions, the moment is upon us when a major American city will die, leaving nothing but a few shells for tourists to visit like a museum.

We said this wouldn't happen. President Bush said it wouldn't happen. He stood in Jackson Square and said, "There is no way to imagine America without New Orleans." But it has been over three months since Hurricane Katrina struck and the city is in complete shambles.

There are many unanswered questions that will take years to work out, but one is make-or-break and needs to be dealt with immediately. It all boils down to the levee system. People will clear garbage, live in tents, work their fingers to the bone to reclaim homes and lives, but not if they don't believe they will be protected by more than patches to the same old system that failed during the deadly storm. Homeowners, businesses and insurance companies all need a commitment before they will stake their futures on the city.

At this moment the reconstruction is a rudderless ship. There is no effective leadership that we can identify. How many people could even name the president's liaison for the reconstruction effort, Donald Powell? Lawmakers need to understand that for New Orleans the words "pending in Congress" are a death warrant requiring no signature.

The rumbling from Washington that the proposed cost of better levees is too much has grown louder. Pretending we are going to do the necessary work eventually, while stalling until the next hurricane season is upon us, is dishonest and cowardly. Unless some clear, quick commitments are made, the displaced will have no choice but to sink roots in the alien communities where they landed.

The price tag for protection against a Category 5 hurricane, which would involve not just stronger and higher levees but also new drainage canals and environmental restoration, would very likely run to well over $32 billion. That is a lot of money. But that starting point represents just 1.2 percent of this year's estimated $2.6 trillion in federal spending, which actually overstates the case, since the cost would be spread over many years. And it is barely one-third the cost of the $95 billion in tax cuts passed just last week by the House of Representatives.

Total allocations for the wars in Iraq and Afghanistan and the war on terror have topped $300 billion. All that money has been appropriated as the cost of protecting the nation from terrorist attacks. But what was the worst possible case we fought to prevent?

Losing a major American city.

"We'll not just rebuild, we'll build higher and better," President Bush said that night in September. Our feeling, strongly, is that he was right and should keep to his word. We in New York remember well what it was like for the country to rally around our city in a desperate hour. New York survived and has flourished. New Orleans can too.

Of course, New Orleans's local and state officials must do their part as well, and demonstrate the political and practical will to rebuild the city efficiently and responsibly. They must, as quickly as possible, produce a comprehensive plan for putting New Orleans back together. Which schools will be rebuilt and which will be absorbed? Which neighborhoods will be shored up? Where will the roads go? What about electricity and water lines? So far, local and state officials have been derelict at producing anything that comes close to a coherent plan. That is unacceptable.

The city must rise to the occasion. But it will not have that opportunity without the levees, and only the office of the president is strong enough to goad Congress to take swift action. Only his voice is loud enough to call people home and convince them that commitments will be met.

Maybe America does not want to rebuild New Orleans. Maybe we have decided that the deficits are too large and the money too scarce, and that it is better just to look the other way until the city withers and disappears. If that is truly the case, then it is incumbent on President Bush and Congress to admit it, and organize a real plan to help the dislocated residents resettle into new homes. The communities that opened their hearts to the Katrina refugees need to know that their short-term act of charity has turned into a permanent commitment.

If the rest of the nation has decided it is too expensive to give the people of New Orleans a chance at renewal, we have to tell them so. We must tell them we spent our rainy-day fund on a costly stalemate in Iraq, that we gave it away in tax cuts for wealthy families and shareholders. We must tell them America is too broke and too weak to rebuild one of its great cities.

Our nation would then look like a feeble giant indeed. But whether we admit it or not, this is our choice to make. We decide whether New Orleans lives or dies.

Jamster Pokes Into Full-Song, Mobile Download Space

The force behind the Crazy Frog is now diversifying. Jamster, owned by VeriSign, will soon deliver over-the-air, full-track mobile downloads. The move was announced earlier this week, and will involve digital rights technology supplied by Seattle-based Melodeo. "We chose to work with Melodeo because music labels have endorsed their technology and because of the need in the mobile marketplace for digital rights protection," said Mahi de Silva, senior vice president at VeriSign Communications Services. Other details, including total catalog, launch dates and pricing, were not revealed.

The Jamster plans come on the heels of similar news from Los Angeles-based MVNO Amp'd Mobile, which will offer full-track mobile downloads at a money-losing 99-cents. Exactly how Jamster will price its tones is unclear at this point, though the service will directly compete with carriers by offering an SMS-based ordering process. Regardless of price, overall adoption of full-track downloads remains a question mark, especially with the presence of easy side-loading on a large number of mobile device. Regardless, this a tough market to predict, especially since a $4 billion ringtone market exists alongside several do-it-yourself services.

It's easy to dismiss Confessions of a Video Vixen, a book by ex-groupie turned 15-minute-fame-purveyor Karrine Steffans, which is rocking the hip-hop world.

Although Steffans -- whose tell-all remains on The New York Times bestseller list -- bills her story as a cautionary tale to young girls aspiring to be the next hottie in a hip-hop video, she lacks the necessary introspection and self-criticism, and she has an inflated view of herself and the goldilocks weave she sports.

So what if Steffans drank and did lots of drugs with A-list rappers and athletes? Her sexual diary includes romps with Jay-Z, Ja Rule, Damon Dash, DMX, Dr. Dre, Shaquille O'Neal, Irv Gotti, P. Diddy, Ice-T, and Fred Durst. Rappers passed her along to friends like bottom-shelf champagne.

Still, there is something to her story. Women's voices in hip-hop are muted, and Steffans' book comes along at a curious time. Essence magazine is attempting a campaign to take back the music, protesting vile video images degrading black women. Hip-hop feminist conferences are sprouting up across the country.

Meanwhile, the "video vixens" subculture is a be-seen-and-not-heard paradigm. Indeed, though Steffans' voice shouldn't be elevated as an emblematic one, in a fair critique of the video industry, accounts like hers need to be included. While Steffans has bought into the hegemony of her fate, she is offering a narrative in a genre that essentially relegates women to visual eye candy. Despite her poor choices, Steffans' tale has the potential to at least advance the debate.

"You would like to think [that] maybe these men who are exploiting women in hip-hop videos…will think twice, because you could be named or called out," says Gwendolyn Pough, a professor at Syracuse University and author of Check It While I Wreck It: Black Womanhood, Hip-Hop Culture, and the Public Sphere.

Pough says young girls who read Confessions need to understand how Steffans was objectified. "The story she ends up sharing, for people who want to help younger black women, knowing about those kinds of pitfalls and traps out there is helpful on that level."

Steffans, a former stripper, would sidle up to rappers on the set. After working a day on Jay-Z's "Hey Papi" video, the two took a beach drive that ended with him whipping out a condom and placing his hand on the back of her neck. When Irv Gotti wanted to kick her off the set of Ja Rule's "Between Me and You," Steffans, um, convinced him orally.

"She's very smart when it came to thinking about something to market. That, to me, is genius," says Whyte Chocolate, the Atlanta video dancer who stirred controversy last year by having her rear end swiped with a credit card by Nelly in "Tip Drill." But the veteran of 30 videos adds that Steffans is more groupie than video dancer, given that her portfolio is only a handful. "If she's a video vixen, then what the hell am I -- a video queen? This book was a disappointment. It could've been more exciting. What she said was true -- the artists wanting to fuck and get their dicks sucked. But it's not for everybody. She portrayed herself as a ho…You are only as good as your reputation. I built mine. Don't stereotype me. You earn the respect you demand."

Steffans is promoting herself with the aplomb of an ex-reality television star, appearing on urban radio shows, giving book signings and interviews. Her book caused so much stir in New York that she had to hire a bodyguard, and endure the wrath of emcees' wives calling radio stations, incensed at her accusations and pluck.

And some wonder if her narrative is giving ammunition to feminists -- or setting back women in hip-hop. "She's clearly an opportunist, and her perspective is sort of delusional. Her take on a lot of her 'relationships' are romantic when it's obvious to me…that the [rappers] really didn't see her as a romance. They saw her as sex. She sort of glamorizes this idea that she's having sex with these people. I don't see where there was a relationship or a bond there," says Tunesia Turner, of the Detroit-based hip-hop/soul group Black Bottom Collective.

Steffans tries to justify her reasoning -- she grew up in a household rife with emotional and physical abuse. Her baby-daddy is rap pioneer Kool G Rap, a man she hooked up with at age 17 and whom she claims beat her and forced her to perform oral sex until her nose bled.

She escaped his thumb, venturing to Los Angeles and immersing herself in the glamorous hip-hop world of parties, VIPs, and decadence. "The top reason a woman finds herself in a rap video, sprawled undressed over a luxury car while a rapper is saying lewd things about her, is a lack of self-esteem. I know it sounds like a cliché, but no one who values, loves, or knows herself would allow herself to be placed in such a degrading position," Steffans writes in the introduction.

But after she finishes her underbelly tour and learns that people like Shaq won't break her off any significant loot after she crumbles, Steffans veers back into her old ways. She trademarks the name "Superhead," a sexual nickname that stuck like ear wax. Steffans also writes that she can't wait for her son to read the book, and concludes by saying that she would do it all again.

KaZaA Farce Plays Out in Australia

After receiving a court order requiring that it filter unauthorized file transfers, KaZaA predictably could not create the filter to meet the December 5 deadline. (Remember that the original Napster simply went out of business rather than even try to comply with a similar court order.) Instead, parent company Sharman Networks blocked downloads of its KaZaA program in Australia, and put a big, futile “DON’T USE” notice on the screens of existing users. This all bears about the same symbolic relation to reality as a Kabuki drama. First, KaZaA is pretty much off the radar of today’s most aggressive and determined file-sharers. Second, nothing is stopping millions of existing KaZaA owners from sharing as always. Nothing can ever stop them. And for this gestural charade the music industry is actually investing time and resources.

SAN FRANCISCO - What a short, strange trip it was. After the Grateful Dead angered some of its biggest fans by asking a nonprofit Web site to halt the free downloading of its concert recordings, the psychedelic jam band changed its mind Wednesday.

Internet Archive, a site that catalogues content on Web sites, reposted recordings of Grateful Dead concerts for download after the surviving members of the band decided to make them available again.

Band spokesman Dennis McNally said the group was swayed by the backlash from fans, who for decades have freely taped and traded the band’s live performances.

“The Grateful Dead remains as it always has — in favor of tape trading,” McNally said.

He said the band consented to making audience recordings available for download again, although live recordings made directly from concert soundboards, which are the legal property of the Grateful Dead, should only be made available for listening from now on.

The soundboard recordings are “very much part of their legacy, and their rights need to be protected,” McNally said.

Representatives for the band earlier this month had directed the Internet Archive to stop making recordings of the group’s concerts available for download. But fans quickly initiated an online petition that argued the band shouldn’t change the rules midway through the game.

“The internet archive has been a resource that is important to all of us,” states the petition, which also threatened a boycott of Grateful Dead recordings and merchandise. “Between the music, and interviews in the archive we are able to experience the Grateful Dead fully.”

The Grateful Dead disbanded in 1995 following the death of guitarist and lead singer Jerry Garcia. The group once set concert attendance records and generated millions of dollars in revenue from extensive tours.

With concert tickets now removed as a source of revenue, sales of the band’s music and other merchandise have become increasingly important in an age where music is distributed digitally instead of on CDs, vinyl and cassette tapes.

And the arrival of Apple Computer Inc.’s iTunes online music store, and other similar sites, means free downloads can be seen as competition, said Marc Schiller, chief executive of Electricartists, which helps musicians market themselves online.

The band sells music on iTunes and exclusive shows through its Web site.

“When the music was given away for free to trade, the band was making so much money touring that the music was not as valuable to them,” Schiller said. “Apple iTunes has made digital downloads a business.”

The Grateful Dead’s freeform improvisational style led to vastly different sounding songs, from year to year or even night to night. A song that lasted four minutes during one performance could be stretched to 20 minutes during a different show.

Fans eager to explore the varying versions frequently built large collections of shows spanning the band’s 30-year career. The band even encouraged recording of their live shows, establishing a cordoned section for fans to set up taping equipment.

Representatives from the Internet Archive didn’t immediately return a telephone call seeking comment Wednesday.

Whenever I talk to a band who are about to sign with a major label, I always end up thinking of them in a particular context. I imagine a trench, about four feet wide and five feet deep, maybe sixty yards long, filled with runny, decaying shit. I imagine these people, some of them good friends, some of them barely acquaintances, at one end of this trench. I also imagine a faceless industry lackey at the other end holding a fountain pen and a contract waiting to be signed. Nobody can see what's printed on the contract. It's too far away, and besides, the shit stench is making everybody's eyes water. The lackey shouts to everybody that the first one to swim the trench gets to sign the contract. Everybody dives in the trench and they struggle furiously to get to the other end. Two people arrive simultaneously and begin wrestling furiously, clawing each other and dunking each other under the shit. Eventually, one of them capitulates, and there's only one contestant left. He reaches for the pen, but the Lackey says "Actually, I think you need a little more development. Swim again, please. Backstroke". And he does of course.

Every major label involved in the hunt for new bands now has on staff a high-profile point man, an "A & R" rep who can present a comfortable face to any prospective band. The initials stand for "Artist and Repertoire." because historically, the A & R staff would select artists to record music that they had also selected, out of an available pool of each. This is still the case, though not openly. These guys are universally young [about the same age as the bands being wooed], and nowadays they always have some obvious underground rock credibility flag they can wave.

Lyle Preslar, former guitarist for Minor Threat, is one of them. Terry Tolkin, former NY independent booking agent and assistant manager at Touch and Go is one of them. Al Smith, former soundman at CBGB is one of them. Mike Gitter, former editor of XXX fanzine and contributor to Rip, Kerrang and other lowbrow rags is one of them. Many of the annoying turds who used to staff college radio stations are in their ranks as well. There are several reasons A & R scouts are always young. The explanation usually copped-to is that the scout will be "hip to the current musical "scene." A more important reason is that the bands will intuitively trust someone they think is a peer, and who speaks fondly of the same formative rock and roll experiences. The A & R person is the first person to make contact with the band, and as such is the first person to promise them the moon. Who better to promise them the moon than an idealistic young turk who expects to be calling the shots in a few years, and who has had no previous experience with a big record company. Hell, he's as naive as the band he's duping. When he tells them no one will interfere in their creative process, he probably even believes it. When he sits down with the band for the first time, over a plate of angel hair pasta, he can tell them with all sincerity that when they sign with company X, they're really signing with him and he's on their side. Remember that great gig I saw you at in '85? Didn't we have a blast. By now all rock bands are wise enough to be suspicious of music industry scum. There is a pervasive caricature in popular culture of a portly, middle aged ex-hipster talking a mile-a-minute, using outdated jargon and calling everybody "baby." After meeting "their" A & R guy, the band will say to themselves and everyone else, "He's not like a record company guy at all! He's like one of us." And they will be right. That's one of the reasons he was hired.

These A & R guys are not allowed to write contracts. What they do is present the band with a letter of intent, or "deal memo," which loosely states some terms, and affirms that the band will sign with the label once a contract has been agreed on. The spookiest thing about this harmless sounding little memo, is that it is, for all legal purposes, a binding document. That is, once the band signs it, they are under obligation to conclude a deal with the label. If the label presents them with a contract that the band don't want to sign, all the label has to do is wait. There are a hundred other bands willing to sign the exact same contract, so the label is in a position of strength. These letters never have any terms of expiration, so the band remain bound by the deal memo until a contract is signed, no matter how long that takes. The band cannot sign to another laborer or even put out its own material unless they are released from their agreement, which never happens. Make no mistake about it: once a band has signed a letter of intent, they will either eventually sign a contract that suits the label or they will be destroyed.

One of my favorite bands was held hostage for the better part of two years by a slick young "He's not like a label guy at all," A & R rep, on the basis of such a deal memo. He had failed to come through on any of his promises [something he did with similar effect to another well-known band], and so the band wanted out. Another label expressed interest, but when the A & R man was asked to release the band, he said he would need money or points, or possibly both, before he would consider it. The new label was afraid the price would be too dear, and they said no thanks. On the cusp of making their signature album, an excellent band, humiliated, broke up from the stress and the many months of inactivity. There's this band. They're pretty ordinary, but they're also pretty good, so they've attracted some attention. They're signed to a moderate-sized "independent" label owned by a distribution company, and they have another two albums owed to the label. They're a little ambitious. They'd like to get signed by a major label so they can have some security you know, get some good equipment, tour in a proper tour bus -- nothing fancy, just a little reward for all the hard work. To that end, they got a manager. He knows some of the label guys, and he can shop their next project to all the right people. He takes his cut, sure, but it's only 15%, and if he can get them signed then it's money well spent. Anyways, it doesn't cost them anything if it doesn't work. 15% of nothing isn't much! One day an A & R scout calls them, says he's 'been following them for a while now, and when their manager mentioned them to him, it just "clicked." Would they like to meet with him about the possibility of working out a deal with his label? Wow. Big Break time. They meet the guy, and y'know what -- he's not what they expected from a label guy. He's young and dresses pretty much like the band does. He knows all their favorite bands. He's like one of them. He tells them he wants to go to bat for them, to try to get them everything they want. He says anything is possible with the right attitude.

They conclude the evening by taking home a copy of a deal memo they wrote out and signed on the spot. The A & R guy was full of great ideas, even talked about using a name producer. Butch Vig is out of the question-he wants 100 g's and three points, but they can get Don Fleming for $30,000 plus three points. Even that's a little steep, so maybe they'll go with that guy who used to be in David Letterman's band. He only wants three points. Or they can have just anybody record it (like Warton Tiers, maybe-- cost you 5 or 7 grand] and have Andy Wallace remix it for 4 grand a track plus 2 points. It was a lot to think about. Well, they like this guy and they trust him. Besides, they already signed the deal memo. He must have been serious about wanting them to sign. They break the news to their current label, and the label manager says he wants them to succeed, so they have his blessing. He will need to be compensated, of course, for the remaining albums left on their contract, but he'll work it out with the label himself.

Sub Pop made millions from selling off Nirvana, and Twin Tone hasn't done bad either: 50 grand for the Babes and 60 grand for the Poster Children-- without having to sell a single additional record. It'll be something modest. The new label doesn't mind, so long as it's recoupable out of royalties. Well, they get the final contract, and it's not quite what they expected. They figure it's better to be safe than sorry and they turn it over to a lawyer--one who says he's experienced in entertainment law and he hammers out a few bugs. They're still not sure about it, but the lawyer says he's seen a lot of contracts, and theirs is pretty good. They'll be great royalty: 13% [less a 1O% packaging deduction]. Wasn't it Buffalo Tom that were only getting 12% less 10? Whatever. The old label only wants 50 grand, an no points. Hell, Sub Pop got 3 points when they let Nirvana go. They're signed for four years, with options on each year, for a total of over a million dollars! That's a lot of money in any man's English. The first year's advance alone is $250,000. Just think about it, a quarter million, just for being in a rock band! Their manager thinks it's a great deal, especially the large advance. Besides, he knows a publishing company that will take the band on if they get signed, and even give them an advance of 20 grand, so they'll be making that money too. The manager says publishing is pretty mysterious, and nobody really knows where all the money comes from, but the lawyer can look that contract over too. Hell, it's free money. Their booking agent is excited about the band signing to a major. He says they can maybe average $1,000 or $2,000 a night from now on. That's enough to justify a five week tour, and with tour support, they can use a proper crew, buy some good equipment and even get a tour bus! Buses are pretty expensive, but if you figure in the price of a hotel room for everybody In the band and crew, they're actually about the same cost. Some bands like Therapy? and Sloan and Stereolab use buses on their tours even when they're getting paid only a couple hundred bucks a night, and this tour should earn at least a grand or two every night. It'll be worth it. The band will be more comfortable and will play better.

The agent says a band on a major label can get a merchandising company to pay them an advance on T-shirt sales! ridiculous! There's a gold mine here! The lawyer Should look over the merchandising contract, just to be safe. They get drunk at the signing party. Polaroids are taken and everybody looks thrilled. The label picked them up in a limo. They decided to go with the producer who used to be in Letterman's band. He had these technicians come in and tune the drums for them and tweak their amps and guitars. He had a guy bring in a slew of expensive old "vintage" microphones. Boy, were they "warm." He even had a guy come in and check the phase of all the equipment in the control room! Boy, was he professional. He used a bunch of equipment on them and by the end of it, they all agreed that it sounded very "punchy," yet "warm." All that hard work paid off. With the help of a video, the album went like hotcakes! They sold a quarter million copies! Here is the math that will explain just how fucked they are: These figures are representative of amounts that appear in record contracts daily. There's no need to skew the figures to make the scenario look bad, since real-life examples more than abound. income is bold and underlined, expenses are not.

The band is now 1/4 of the way through its contract, has made the music industry more than 3 million dollars richer, but is in the hole $14,000 on royalties. The band members have each earned about 1/3 as much as they would working at a 7-11, but they got to ride in a tour bus for a month. The next album will be about the same, except that the record company will insist they spend more time and money on it. Since the previous one never "recouped," the band will have no leverage, and will oblige. The next tour will be about the same, except the merchandising advance will have already been paid, and the band, strangely enough, won't have earned any royalties from their T-shirts yet. Maybe the T-shirt guys have figured out how to count money like record company guys. Some of your friends are probably already this fucked.

Slate’s Adam Penenberg has a problem with 99-cent downloads: they’re cheap and they cost too much. Why charge buyers of an obscure Jelly Roll Morton track the same amount that fans of Eminem pay for the rapper’s latest release?

Penenberg’s solution? A commodity exchange for music downloads, where price is a function of demand. “Music prices would oscillate like stocks on Nasdaq,” Penenberg writes, “with the current cost pegged to up-to-the-second changes in the number of downloads.”

Certainly, the idea seems sensible. After all, if physical record stores can have discount bins, why can’t digital stores do the same? Market pricing would also hush some of the clamoring by labels for flexible (read: higher) pricing, while giving consumers both transparency in pricing and incentive to discover under-appreciated (and thus under-priced) music.

Penenberg isn’t the first to float this idea. In 2001, a team of PhD-level psychologists, tinkering with “the social impact of digital file transfer,” launched MusicRebellion, which employed “dynamic pricing,” in which consumer demand pushed the price of a song up and down along a set algorithm.

Apparently, the idea was too sensible to work.

MusicRebellion’s “inquiry” (see what happens when PhDs launch a business?) doesn’t seem to have produced profitable answers. Last spring, the company ceded its major label business to MSN Music. It continues to sell independent label tracks as MyRebellion.com. The company had to refund MusicRebellion account holders that it couldn’t lure to MyRebellion, where tracks from the top five releases were selling for between 10 and 18 cents apiece this evening.

I couldn’t find the exact details of what went wrong with MusicRebellion, but it occurs to me that there’s something fundamental missing when you try to make a music store behave like the Chicago Mercantile Exchange: buyers have no incentive to see prices rise. Unlike most buyers of cotton contracts, music buyers actually intend to consume what they’ve bought. To date, there’s no secondary market for downloaded music. You can’t buy a futures contract on 50 Cent’s next release. And, since every track can be downloaded an infinite number of times, scarcity can’t affect prices.

Perhaps the average MusicRebellion member bought popular tracks someplace where prices were fixed, such as iTunes or Wal-Mart. That member probably used MusicRebellion for deeply discounted tracks, yielding some exposure for obscure acts, but little to elevate MusicRebellion’s beyond the status of academic exercise.

Many have suggested that downloads should cost 50 cents. I wouldn’t be surprised if MusicRebellion’s “inquiry” led to an equilibrium price point not far from that number. Water does indeed find its own level.

It's the dilemma of downloading: The guy in the next cubicle is using office bandwidth to download the new J.Lo album using Grokster. But then your mother sends you newspaper clippings of all of those nice-looking people getting arrested for file sharing. You want to have the records without having a record. So, there you are—caught between your greed and a guilt complex.

Until you find the silver bullet—the legal way to download music for free. Or at least almost for free. And almost legal: It's called Allofmp3.com, and it's the trendy, angst-free way to download copyrighted music. As the Supreme Court prepares to hear arguments tomorrow about the legality of Grokster, Aimster, and other file-sharing services, downloaders have been looking hopefully to Allofmp3.com as their only legitimate way to get 50 Cent for less than face value.

Allofmp3.com is Russian, and its self-proclaimed quasi-legality stems from its claimed ownership of Russian music distribution rights. As their Web site puts it: "All the materials in the MediaServices projects are available for distribution through Internet according to license # LS-3М-05-03 of the Russian Multimedia and Internet Society. … AllOFMP3.com's Administration does not keep up with the laws of different countries and is not responsible the actions of non-Russian users." This site isn't free, but at about 5 cents a song, it sure beats iTunes.

Could a scheme like Allofmp3.com be legal? Probably. Is it legal, in fact? Probably not. Will you get sued for using it? Not likely, or at least, far less likely than you would be for using Grokster or any of the other peer-to-peer networks. But let's take it one question at a time.

1. Could a site claiming to hold foreign distribution rights be a legal way to download copyrighted music?

Sure. Music licensing agreements vary from distributor to distributor and from country to country. If Allofmp3.com has legitimately acquired Russian distribution rights, it would be legal to download from them the same way that copyright holders have licensed iTunes and Napster in the United States, according to James Gibson, who teaches law at the University of Richmond and wrote a brief supporting the music industry in the MGM v. Grokster case.

But get out your balaclava, pop the caviar, and activate those frequent-flyer miles: Because in order to download legally from a Russian rights-holder, you'd likely have to actually go to Russia. Foreign-rights-holders usually only control the copyright within the country itself, and that includes Internet distribution. (For those of you who prefer traveling to warmer climates, there's a similar—and similarly dubious—Spanish service called weblisten.com.)

There is one other argument that might save Allofmp3, albeit an admittedly far-fetched one: That theory holds that all music downloading is legal under "fair use" doctrine, as long as it's only for personal use. In other words, your officemate is violating only the bounds of taste, and not the bounds of copyright law, by scoring that free J.Lo song.

"If you're writing notes from a book in a library, or making a mix tape, or a clip of music to give to your friends, the law was never meant to apply to you," says Raymond Ku, a law professor at Case Western Reserve University and signatory to a Grokster brief to the same effect. Ku recognizes that American courts have not found his theory particularly convincing thus far, but courts in France and Canada have ruled that downloading copyrighted songs for mere personal use is legal. Then again, wouldn't you encourage the importation of foreign music if your national musical hero was Charles Aznavour or Celine Dion?

2. Is Allofmp3.com actually legal?

Probably not. The discussion above about what Allofmp3.com is allowed to do with international distribution rights assumes the site actually owns those rights. It doesn't—at least not according to the recording industry. The International Federation of the Phonographic Industry is the worldwide organization of recording companies, and it claims that Allofmp3.com has not been licensed to distribute its members' "repertoire" in Russia or anywhere else. While Allofmp3.com claims it owns distribution rights from the Russian Multimedia and Internet Society, the record companies say, "Nyet."

Bruce Boyden, a copyright lawyer at Proskauer Rose, which represents the international copyright holders in Grokster, concedes that there's some dispute as to whether Allofmp3.com has in fact obtained the Russian distribution rights. But he has his suspicions: "Allofmp3.com doesn't sound Russian to me, and it doesn't sound like they're aiming at a Russian audience." Moreover, even if it does hold some Russian distribution rights, it certainly doesn't own worldwide Internet distribution rights.

But there's the law, and then there's enforcement of the law. And you probably shouldn't expect the Russian authorities to crack down on the company anytime soon. According to unverified reports from Russia (and are there any other kind?), authorities there have decided not to prosecute Allofmp3.com, despite a recommendation from Moscow police that they do so. The remaining question—of whether the company could eventually be sued in American courts—turns, at least to some extent, on the results of the Grokster case.

3. Will American users of Allofmp3.com get sued?

Not likely. The Recording Industry Association of America has been bringing about 700 suits per month, but they're against uploaders—people who make music available for copying—and not downloaders. According to Justin Hughes, an associate professor at Cardozo Law School, this distinction is for obvious evidentiary reasons: The only way to catch a downloader is to actually get onto her hard drive and find the files, or spy on the transmission from the uploader to the downloader In KaZaA, Grokster, and Bittorrent, every user is both an uploader and a downloader—my price for downloading "Papa Don't Preach" from you is to let your roommate download "Like a Prayer" from me. But Allofmp3.com is different; users download music but they don't upload it. None of the RIAA's 8,000 lawsuits has involved such a scenario.

Then again, the RIAA could always change its ways and decide to start going after downloaders as well, if that's where the money is. Just because it's ultimately more difficult to prove doesn't mean they won't try, and the music industry has shown it's not averse to scare tactics. The Material Girl herself explained this phenomenon best: "Experience has made me rich and now they're after me."

The Grokster argument tomorrow should address at least some of these questions, including whether copyright violations should be enforceable against file-sharing services and whether downloading music could ever be considered fair use, along with the greater mystery of whether Sandra Day O'Connor can pronounce Gnutella or knows what an ISP is. Camp out early for good seats, and be wary of anyone trying to sell you pirated CDs outside the courthouse.

You Can't Be Too Thin
The skinny new audio format that will replace MP3s—and revolutionize Internet radio.

It's a given that fat broadband lines are the future of online media. But right now, for Internet radio, the future is about slimming down—creating skinny little streams of data that don't eat up too much bandwidth. The key is a new and better audio compression format called aacPlus, or sometimes HE-AAC, which has been chosen by the industry committee that standardized MP3 13 years ago (the Motion Picture Experts Group). If you've tried to listen to online stations, you know they sound grainy if they're streamed at any less than 128 kilobits per second—maybe 96 kbps if you're not fussy. That makes a broadband connection a must. But aacPlus sounds nearly as good as a CD, even when it's compressed enough to play through a dialup line. Don't take my word for it—see the results of the European Broadcasting Union's listener tests, in which aacPlus was deemed the "clear winner" at a dialup-friendly 48 kbps.

AacPlus has been around for a while—it's what XM satellite radio has used from the outset—but recently it's been gaining ground. Future digital music players will support the format just as surely as they do MP3, but you don't have to wait—you can listen to it right now. Install the free Winamp player, which added aacPlus support a few months ago. Then click through the channels on the Tuner2 Web site, which all stream aacPlus sound at 48 kbps or less. I've spent a week comparing them to the higher bandwidth stations served by the big three of Net radio—Yahoo, AOL, and MSN—and only Yahoo's 96 kbps premium subscription channels sound as good. For a tour, skip Tuner2's glut of techno stations and instead try Groove Salad for laid-back electro-lounge music, Radio Paradise for classic rock, and Sky.FM's Mostly Classical channel. (If you're on a Mac or other non-Windows computer, install the free VLC player instead of Winamp.)

It seems crazy until you try it, but Mostly Classical proves that aacPlus can sound great at 24 kbps. At 48 kbps, it's almost as crisp as a CD. At 128 kbps, it can deliver 5.1 channel surround sound. AacPlus works by combining three technologies, each of which shrinks the size of an audio signal. The first is AAC, the Advanced Audio Coding technique that Apple licensed from Dolby for iTunes. AAC analyzes the sound and throws away any data it knows human ears won't be able to hear, which is a lot. Then, aacPlus adds Spectral Band Replication, which strips out all of the music's high frequencies and replaces them with a tiny bit of analytical data. AacPlus players reconstruct the highs as a mathematical function of what's left. As a final space-saving trick, aacPlus tracks are recorded in parametric stereo. Instead of a left and a right channel, one channel is the sum of the left and right signals (L+R), and the other is their difference (L-R). This takes up less bandwidth, and the player can easily flip the two channels back to the original left and right. (Bonus trivia: This is how FM stereo broadcasts work.)

Why bother with all this trickery when cheap broadband is spreading everywhere? There are two good reasons. For station owners, lower bandwidth means lower costs. Webcasters spend most of their money paying for network traffic. A station that serves MP3 streams to a thousand listeners at a time can run up a $4,000 monthly bill. Downsizing from 128 kbps to 24 knocks that down to around $1,000. The result: More sites will be able to afford to serve more channels to more listeners, creating a sort of anti-Clear Channel effect. To get an idea just how much variety is already out there on Net radio, spend a few minutes randomly searching Shoutcast's 8,000-channel directory. You can hunt down obscure genres like Ghanaian hilife, listen to alternative newscasters on Radio Chomsky, and check what's playing on nine dozen '80s channels instead of one. Most of these stations broadcast in MP3 format. Imagine what'll happen when the cost of Webcasting goes down by a factor of two, three, or four as aacPlus players become the norm.

Just as important, low-bandwidth stations can reach us in places where we can't get a 128 kbps connection. Today that includes homes with dial-up lines, offices where co-workers share a DSL or T1 connection, and the not-so-speedy Wi-Fi link to my roof. But there's a huge audience looming on the horizon: cellular subscribers. Gadget makers plan to build aacPlus players into 3G phones, PDAs, laptops with cellular modems, maybe even car systems, which could one day tune in to cellular towers instead of satellites, and stream music that actually sounds good straight from the Net. Drivers get excited about 130 channels, but imagine how psyched they'll be with 13,000. Soon, I'll be able to listen to Groove Salad without being stuck at my desk.

How Apple, Microsoft, and Sony cash in on piracy prevention.

A couple of weeks ago, a motley crew of New York University students collected in front of the Virgin Megastore in Union Square for a digital rights rally. Protesters from the NYU chapter of the Free Culture Society brandished signs and snuck inside the store to stick leaflets into racks of CDs. Shades of the student movements of 1968—except that instead of protesting war or agitating for social justice, these college kids took to the streets because corporations are messing with their music.

Back in the days of Napster, MP3 trading was something of a free love movement, with music-adoring scofflaws swapping files under the noses of the record companies. As digital music has become a mass-market, big-money phenomenon, the corporations have succeeded in making digital music a lot less free. By now, thanks in large part to Apple, most people have gotten used to paying for music online. But the other half of the not-free-anymore equation is trickier: Not many music lovers have warmed to the idea that they don't retain all the rights to the music they buy.

The crux of the debate is this: When you buy a song, an album, or a movie, are you buying the content only in the form it comes in? If you purchase a song from Apple's iTunes store, should you be able to play it on any hardware you want? Not according to Apple, which bundles each download with a "digital rights management" scheme called FairPlay. When you pay 99 cents for the latest Sheryl Crow hit, it's stored on your hard drive as an encrypted file. Every time you play it on your computer with iTunes or on your iPod, it is unlocked with a random encryption key supplied by Apple. FairPlay allows you to load a song on up to five computers and an unlimited number of iPods and burn as many CDs as you please. But you can't e-mail a song to a friend, you can't distribute it over the Web, and you can't play it on anything but iTunes or an iPod.

Companies like Apple claim that digital rights management—"digital restrictions management" to critics—is a tool to dampen the threat of piracy, which the record industry claims has cost it billions in revenues. But DRM also locks consumers into using their technologies over those of competitors. The term "FairPlay" is a classic example of technological doublespeak. Since Apple sells about 80 percent of legal music downloads in the United States, FairPlay effectively stunts competition and consumer choice.

Last year, when RealNetworks came up with a product that let users load music from its stores onto iPods, Apple denounced Real's "hacker tactics" and updated its software to block songs from the Real store. A class-action suit that's now winding its way through the courts accuses Apple of effectively forcing consumers to purchase iPods over less-expensive digital music players by unlawfully bundling the iPod and the iTunes Music Store. The stakes for Apple couldn't be greater, since iPod sales now represent a third of the company's revenue—and sales are growing at more than 200 percent a quarter.

Besides Apple's FairPlay, there are two other prominent digital-rights-management technologies on the market. On the software side, Microsoft has licensed Windows Media Audio, which comes equipped with a proprietary copy protection scheme, to Apple rivals like Samsung, the most popular digital music player in Asia. On the compact disc side is Sony's "XCP" anti-piracy technology, which quickly earned a reputation as the most draconian system of them all. When you play an XCP-encoded compact disc on your computer, it covertly installs a "root kit" on your hard drive. The root kit software gives Sony complete access to your computer, as if it were the owner or system administrator.

A day after security firms announced that hackers had started using the Sony root kit to hide malicious programs on users' PCs, Sony announced it would halt production of CDs with XCP. Sony claims it only wanted to limit the number of copies a user could make of a particular CD. What it really did is confirm what many digital music lovers already believe about record execs—that they will do everything they can to wring every last penny from us, even if it means messing with our hard drives.

For decades, piracy has been an irritating song record executives can't get out of their heads. In the late 1970s, LP manufacturers instituted a "spoiler signal" to stop people from copying records onto cassette tape. A spoiler-encoded vinyl record couldn't be taped without an irritating squeal getting copied as well. By sabotaging home tapers, the record companies only alienated consumers and artists, so the spoiler signal was soon abandoned. More to the point: Home taping didn't kill the record industry. Just like the VCR didn't kill television.

While Apple stands alone and Sony self-destructs, Microsoft is practically giving away its digital-rights-management tool in an effort to pick up market share against Apple (so far with little success). We may even see a replay of the Apple-Microsoft battle over the desktop, which ended with Apple holding on to a tiny sliver of the computer market. There is, however, a big difference between then and now. Steve Jobs has a hefty market share and a massive content library made up of millions of songs at a price that people like. As long as the record companies license their content to Apple and consumers flock to the iPod, Apple is in a powerful—some might say Gatesian—position.

What's hardest for the consumer to swallow, then, is that anti-piracy schemes like DRM look like the subtle tactic of the monopolist. Neither Apple nor Microsoft is hurt by music piracy. Instead, they use it as a marketing ploy to force people to use their products. It doesn't have to be this way. The companies could agree on one standard that allows people to play the music they lawfully purchase on whichever player they choose. The music industry is supposed to sell music, not the medium it comes in, right?

Will The DOJ Investigate Sony?

It concerns me the fact that the Department of Justice (DOJ) has made no comment on the Sony-BMG rootkit story.

Going by the broad definition by which all of the early spyware and malware laws in this country are drafted Sony-BMG seems to be in violation. Only a court of law can decide for sure, especially since these are new laws and the parameters of what triggers a violation and what doesn't have yet to be established. But a court will only decide the matter if charges are brought. No one is even suggesting they may be brought up.

If there are no charges made isn't the DOJ saying through inaction that this is acceptable behavior, or at least behavior that in their view violates no law?

The DOJ has kept silent while one of the biggest cybersecurity intrusions ever hit the press with a fervor. No comment on if Sony-BMG may or may not have broken the law by installing a rootkit on millions of PCs covertly. No details on why they came to their conclusions to act or not act. Nothing.

I personally would feel better I they communicated their thoughts on this, one way or the other. The DOJ certainly has made its thoughts clear on file sharing.

The Intellectual Property Protection Act of 2005

The other week US Attorney General Alberto Gonzales announced a new bill the Department of Justice sent to Congress. The bill, called The Intellectual Property Protection Act of 2005, is designed to toughen penalties against intellectual property violations. The problem I have with this bill is that this action is driven through the efforts of a movie and record industry with a sky-is-falling attitude. Their clear intention is to erode - for their added enrichment - the fair use rights we as Americans enjoy.

As an MBA I know this is not good business, though in the short run it may appear to be. I say that because real financial growth comes through innovation and opportunity, not by upholding the status quo. In terms of content distribution the Internet is the most efficient tool to ever appear. It's so efficient that I can make music files available to the world from my living room for almost no cost. A significant reduction in cost is probably the greatest opportunity for any established industry, but if an industry barely explores that opportunity it's moot. The record and movie industries are suspect of the Net and were quite slow to exploit the opportunities brought on by it. So slow that consumers simply did it themselves in the form of file sharing.

The content industry calls file sharing piracy, but it also called the VCR piracy. It called home taping piracy too. Neither were. Some people - including recording artists like Janis Ian - call file sharing fair use, but they don't have a well-funded lobby on Capitol Hill.

Anyway, the content industries call file sharing piracy, the newspapers they put their ads in call it piracy, and now the US Attorney General has proposed a law that will officially and unambiguously declare it piracy and make it a felony.

Mr. Gonzales, if you believe that grandmothers should go to jail for sharing the jaunty tunes of 50-cents, how do you think we should handle this Sony rootkit scandal? A rootkit that, irony of ironies, may also have infringed anothers intellectual property.

Leading information security companies from Symantec to McAfee officially classify the Sony rootkit as a Trojan. Corporations are now forced to spend time and money to root out the rootkit that has exposed their networks to attack. It seems to warrant at least an investigation.

If the DOJ is eager to go after small time hoods and homeowners for copyright infringement, you would think they would go after one of the most successful enablers of malware in the history of information security. After all, Sony had this code out for months before anyone detected it. They sold over two million of these discs in that time and may have infected just as many PCs.

I have heard the DOJ try to claim that P2P applications can be used to facilitate terrorism. Personally, I think that is a bit of a stretch, but even if you could convince me of the logic don't you think Al Qaida might find the vulnerabilities the Sony-BMG rootkit creates a bit more useful? Which is the greater threat here?

Again, I would like to hear from the DOJ. I would like to hear their reasoning.

Unauthorized

Should these various bills become law it would criminalize unauthorized activities with regards to copyrights. And what qualifies as unauthorized? Since these bills are the progeny of the copyright industry they lean to giving the industry the right to define what ultimately constitues infringement.

Let's take a silly example to make my point using an extreme. Let's say that the record industry decides that CDs can no longer be played on automobile sound systems. In this world they release an End User License Agreement (EULA) with every new record that states the copyright owner does not authorize such use. Listen to a CD in your car anyway and you can go to jail. How? Because the EULA serves as a form of contract that dictates the terms of acceptable use. Any violation is a felony.

Now the above example is intentionall a silly one, an example that will never happen because it is so silly. Or is it?

After the Sony-BMG rootkit scandal the Electronic Frontier foundation (EFF) reviewed the End User License Agreement (EULA) Sony placed on their copy-protected CDs. What they discovered is that Sony-BMG is already populating their EULA's with the silly. This is what the EFF found underneath the legalese, which is comical if not surreal. It is genuinely funny, yet if the DOJ's bill were to become law ignoring what's funny might become - a crime!

What the EFF's legal minds pulled from the Sony EULA:

1. If your house gets burgled, you have to delete all your music from your laptop when you get home. That's because the EULA says that your rights to any copies terminate as soon as you no longer possess the original CD.

2. You can't keep your music on any computers at work. The EULA only gives you the right to put copies on a "personal home computer system owned by you."

3. If you move out of the country, you have to delete all your music. The EULA specifically forbids "export" outside the country where you reside.

4. You must install any and all updates, or else lose the music on your computer. The EULA immediately terminates if you fail to install any update. No more holding out on those hobble-ware downgrades masquerading as updates.

5. Sony-BMG can install and use backdoors in the copy protection software or media player to "enforce their rights" against you, at any time, without notice. And Sony-BMG disclaims any liability if this "self help" crashes your computer, exposes you to security risks, or any other harm.

6. The EULA says Sony-BMG will never be liable to you for more than $5.00. That's right, no matter what happens, you can't even get back what you paid for the CD.

7. If you file for bankruptcy, you have to delete all the music on your computer. Seriously.

8. You have no right to transfer the music on your computer, even along with the original CD.

9. Forget about using the music as a soundtrack for your latest family photo slideshow, or mash-ups, or sampling. The EULA forbids changing, altering, or make derivative works from the music on your computer.

Does anyone reading this feel that not erasing all the music on your PC after a bankruptsy should be a crime? Does anyone reading this feel that number 5 on this list is acceptable?

The DOJ is more than willing to let the courts decide when average consumers are violating the law. They are willing to pen new laws that add further restrictions to the use of copyrighted material. Why won't they give us their opinion on whether Sony has done something wrong with regards to the Cybersecurity laws already on the books?

I would like the DOJ to tell us if they will or won't investigate the Sony-BMG matter. I would then like them to detail to the public how they came to their conclusions. If they are reasonable I'll accept them. If they simply say something I'll feel better.

Free Marc Emery

On Friday, July 29th, 2005, Marc Emery was arrested by Halifax police while vacationing in Nova Scotia. His business in Vancouver was raided by Vancouver police. Two of Mr. Emery's business associates, Greg Williams, and Michelle Rainey-Fenkarek were arrested in Vancouver. The United States Drug Enforcement Agency requested both operations after getting an indictment against Mr. Emery from a Washington state Grand Jury. They want Canada to extradite him and his associates to the United States so they can be tried for drug trafficking and money laundering and be put in jail for 10 years to life. There is a possibility that they will attempt to invoke the death penalty. Draconian U.S. drug laws allow it to be used for drug "kingpins".

Mr. Emery is not being accused of hurting anyone, and he hasn't. He sells marijuana seeds by mail order. He actively and successfully works politically towards marijuana legalization. It is likely his political activism that has caused the DEA to target him instead of numerous other mail-order marijuana seed businesses.

• Week 16 (Dec. 24): Detroit at San Antonio

NEW YORK -- The New Orleans Saints will play four home games at Tiger Stadium in Baton Rouge, La., and three in the Alamodome in San Antonio this season.

The Saints, displaced when Hurricane Katrina devastated the New Orleans area and their Superdome home, will play the weekends of Oct. 30-31, Nov. 6-7, Dec. 4-5 and Dec. 17-19 on the campus of LSU in Baton Rouge. The San Antonio games will be on the weekends of Oct. 2-3, Oct. 16-17 and Dec. 24-26.

Specific days and starting times for those games have not been determined.

"I think the time frame gives our fans time to get tickets or do whatever they have to do to get to the stadium," coach Jim Haslett said from the team's temporary practice facility in San Antonio.

The four home games at Baton Rouge will be against Miami, Chicago, Tampa Bay and Carolina. The San Antonio games will be against Buffalo, Atlanta and Detroit.

Haslett initially wanted to play as many games in Louisiana as possible. But after spending last week getting settled into their new routine in San Antonio, he began hoping for more games to be at the Alamodome.

"It would have been nice to play here," he said. "It's more of a travel issue. I know what their agenda was, to play as many games as possible in our home state. Our players like that, too. ...

"I'm not really worried about the location," he said. "Our first concern is just to win football games."

No decision was made on the site of potential Saints home playoff games this season.

Agreement on the schedule was reached after a meeting Monday in Baton Rouge involving Saints owner Tom Benson, NFL commissioner Paul Tagliabue, LSU chancellor Sean O'Keefe and other school officials.

"We had an excellent meeting this morning and quickly developed a dual consensus," Tagliabue said. "The first was to continue to give priority to the needs of the region and the second to the scheduling of Saints games in a way that made sense under the total circumstances. ... We also appreciate the cooperation of the Alamodome officials and the hospitality of the people of San Antonio for their support of the Saints at this difficult time."

Benson scheduled a news conference for later Monday.

The Saints won their season opener 23-20 at Carolina on Sunday. Their first home game was set for this coming Sunday, but was moved to Monday night and will be played at Giants Stadium against the Giants. Saints season-ticket holders and anyone who had purchased tickets for the Giants-Saints game at the Superdome were given first call for tickets to the relocated game. After that, however, Giants season-ticket holders were given priority, meaning it will be a true road game for the Saints.

The manager of the Superdome has said it will take months before the building's future can be determined. It's possible to stadium will be torn down, leaving the Saints to find a new home.

During Hurricane Katrina, with thousands inside seeking refuge, three large holes were blown through the roof. In all, about 70 percent of the roof failed and water poured into the building during the storm, along with debris.

The concept of the Silent Disco, which started in the Netherlands, is becoming popular in other parts of Europe.

Developed in the Netherlands, the concept involves a DJ, numerous sets of wireless headphones and a certain lack of shame, as clubbers dance on a quiet floor.

Instead of being played out through speakers, the music at Silent Discos is delivered to dancers' ears via their own sets of wireless headphones.

Partygoers tune into a restricted radio frequency through which the music of the DJ is broadcast.

The people behind the project, Nico "No DJ" Okkerse and Michael "DJ Od" Minten, are veterans of the Dutch arts scene.

The DJs, whose company is known as 433fm.com, came up with the concept in 2002 and say the aim is for people "to go wild in silence."

They told CNN they are confident that in the ever changing world of clubbing, it is better to be seen than heard.

"The music is very intense and you hear everything perfectly. People know that the party is exclusive to them, so it gives a good feeling," Minten told CNN.

A silent disco was held in June at this year's Glastonbury Festival, in the west of England, to enable the party to go on later into the evening without infringing the noise curfew.

Festival-goers at the dance tent were issued with free headphones, complete with bass, volume and treble controls, so they could have the music as loud as they liked.

Minten told CNN the concept has been well-received where ever they had held the events, including in Belgium, Spain, Italy and Scotland.

In a year's time, the pair hoped to master a six-channel sound system to enable entire music festivals to happen silently.

New York — It began, fittingly enough, with jazz from New Orleans natives Harry Connick Jr. and Wynton Marsalis.

But "A Concert for Hurricane Relief," a heartfelt and dignified benefit aired on NBC and other networks Friday night, took an unexpected turn thanks to the outspoken rapper Kanye West. Appearing two-thirds through the program, he claimed "George Bush doesn't care about black people" and said America is set up "to help the poor, the black people, the less well-off as slow as possible."

The show, simulcast from New York on NBC, MSNBC, CNBC and Pax, was aired live to the East Coast, enabling the Grammy-winning rapper's outburst to go out uncensored.

There was a several-second tape delay, but the person in charge "was instructed to listen for a curse word, and didn't realize (West) had gone off-script," said NBC spokeswoman Rebecca Marks.

Immediately after the airing was over, Marks said it was undetermined how much, if any, of the tirade would be included in the taped West Coast feed three hours later.

The host was NBC News' Matt Lauer, who invited viewers to contribute to the American Red Cross Disaster Relief Fund by phone or on the Web. Some 18 presenters performed musical numbers or gave information on the tragedy's huge scope.

Louisiana native Tim McGraw teared up as he told Lauer, "I know the citizens that weren't affected by this directly are gonna stand up and do good things for people." He sang two songs, then became the first of the evening's stars to sign a Gibson Les Paul Special guitar to be auditioned online.

Faith Hill, a Mississippi native, sang "There Will Come a Time," with the inspiring lyrics, "The darkness will be gone, the weak shall be strong. Hold on to your faith."

New Orleans son Aaron Neville performed Randy Newman's soulful "Louisiana 1927" with the memorable chorus, "they're trying to wash us away, they're trying to wash us away."

New York governor George Pataki presented the Red Cross with a check for $2.5-million (U.S.) and promised, "This great state will do far more."

"In terms of property damage," said actress Hilary Swank, "the estimate is at least $26-billion in insured losses and perhaps twice that in uninsured losses over a 90,000-square-mile area — approximately the size of Kansas."

Other speakers included Lindsay Lohan, Eric LaSalle, Glenn Close, Richard Gere, John Goodman and Leonardo DiCaprio.

Comedian Mike Myers was paired with West for a 90-second segment that began with Myers speaking of Katrina's devastation. Then, to Myers' evident surprise, West began a rant by saying, "I hate the way they portray us in the media. If you see a black family, it says they're looting. See a white family, it says they're looking for food."

While allowing that "the Red Cross is doing everything they can," West — who delivered an emotional outburst at the American Music Awards after he was snubbed for an award — declared that government authorities are intentionally dragging their feet on aid to the Gulf Coast. Without getting specific, he added, "They've given them permission to go down and shoot us."

After he stated, "George Bush doesn't care about black people. Please call —" the camera cut away to comedian Chris Tucker.

Concluding the hour a few minutes later, Lauer noted that "emotions in this country right now are running very high. Sometimes that emotion is translated into inspiration, sometimes into criticism. We've heard some of that tonight. But it's still part of the American way of life."

Then the entire ensemble performed "When the Saints Go Marching In."

In a statement, NBC said, "Kanye West departed from the scripted comments that were prepared for him, and his opinions in no way represent the views of the networks.

"It would be most unfortunate," the statement continued, "if the efforts of the artists who participated tonight and the generosity of millions of Americans who are helping those in need are overshadowed by one person's opinion."

Friday's program was the first of several TV benefits planned through next weekend.

NBC and the five other major commercial broadcast networks, along with PBS, plan to unite next Friday for a special. The same night, BET will air a benefit. And on Saturday, Sept. 10, the MTV networks will air a special.

Stories Differ In Rave Raid; Court May Decide

(KUTV) SALT LAKE CITY The Utah County Sheriff's Office may be facing a federal lawsuit. The SWAT team raided a party in Spanish Fork Canyon Saturday night and said they found drugs and the party was a rave.

Organizers of the event say they had a permit, and the SWAT team used excessive force. Now, they're talking to a noted Utah civil rights lawyer.

Rod Decker reports that any lawsuit would likely be filed in federal court. A section of federal law called 1983 allows people to sue in federal court if law enforcement violates their civil rights.

“I believe there may well be a civil rights violation here,” said attorney Brian Barnard.

Brian Barnard may have sued more peace officers than any other Utah lawyer. He says he may well sue over a Utah county sheriff's raid on a gathering up Spanish Fork Canyon on August 20.

The facts in the raid remain as confusing as the videos taken of the raid.

2News obtained video taken from the sheriff's helicopter which hovered overhead and also amateur video taken on the ground by one of the partygoers.

The amateur video shows masked SWAT team members taking partygoers to the ground. But the sheriff points out that on one was hit with a night stick or badly injured.

Those who claim to be victims of excessive force, have bruises that are hard to see.

The sheriff displays drugs and paraphernalia that were seized at the party. But promoters say they hired security to search attendees for drugs and alcohol.

The sheriff says the organizers didn't get a permit, but the organizers say they got a permit.

About 60 partygoers were arrested. No one knows how many of those arrested may be charged criminally.

Still, Barnard says the deputies may have acted illegally.

“I question whether or not law enforcement officers have the right to come on the property. I question whether or not there was any need for them to come on like the military. I question whether or not it was appropriate for them to use the amount of force that they did to arrest these people,” Barnard said.

Synthesizer Innovator Robert A. Moog Dies

RALEIGH, N.C. (AP) - Robert A. Moog, whose self-named synthesizers turned electric currents into sound, revolutionizing music in the 1960s and opening the wave that became electronica, has died. He was 71.

Moog died Sunday at his home in Asheville, according to his company's Web site. An inoperable brain tumor had been detected in April.

A childhood interest in the theremin, one of the first electronic musical instruments, would lead Moog to a create a career and business that tied the name Moog as tightly to synthesizers as the name Les Paul is to electric guitars.

Despite traveling in circles that included jet-setting rockers, he always considered himself a technician.

``I'm an engineer. I see myself as a toolmaker and the musicians are my customers,'' he said in 2000. ``They use the tools.''

As a Ph.D. student in engineering physics at Cornell University, Moog - rhymes with vogue - in 1964 developed his first voltage-controlled synthesizer modules with composer Herb Deutsch. By the end of that year, R.A. Moog Co. marketed the first commercial modular synthesizer.

The instrument allowed musicians, first in a studio and later on stage, to generate a range of sounds that could mimic nature or seem otherworldly by flipping a switch, twisting a dial, or sliding a knob. Other synthesizers were already on the market in 1964, but Moog's stood out for being small, light and versatile.

The arrival of the synthesizer came as just as the Beatles and other musicians started seeking ways to fuse psychedelic-drug experiences with their art. The Beatles used a Moog synthesizer on their 1969 album ``Abbey Road''; a Moog was used to create an eerie sound on the soundtrack to the 1971 film ``A Clockwork Orange.''

Keyboardist Walter (later Wendy) Carlos demonstrated the range of Moog's synthesizer by recording the hit album ``Switched-On Bach'' in 1968 using only the new instrument instead of an orchestra.

``Suddenly, there was a whole group of people in the world looking for a new sound in music, and it picked up very quickly,'' said Deutsch, the Hofstra University emeritus music professor who helped develop the Moog prototype.

``The Moog came at the right time,'' he said Monday.

The popularity of the synthesizer and the success of the company named for Moog took off in rock as extended keyboard solos in songs by Manfred Mann, Yes and Pink Floyd became part of the progressive sound of the 1970s.

``The sound defined progressive music as we know it,'' said Keith Emerson, keyboardist for the rock band Emerson, Lake and Palmer.

Along with rock, synthesizers developed since Moog's breakthrough helped inspire elements of 1970s funk, hip-hop, and techno.

Charles Carlini, a New York City concert promoter, staged Moogfest in May 2004 to mark a half-century since Moog founded his first company while still in college. Emerson, Rick Wakeman of Yes, and Bernie Worrell of Parliament/Funkadelic were among those who played, and a second Moogfest was held a year later.

Moog had ``this absent-minded professorial way about him,'' Carlini said.

``He's like an Einstein of music,'' Carlini said. ``He sees it like, there's a thought, an idea in the air, and it passes through him. Passing through him, he's able to build these instruments.''

``A lot of people today don't realize what this man brought to the masses,'' Carlini said. ``He brought electronic music to the masses and changed the way we hear music.''

But the now-pervasive synthesizer's ability to mimic strings, horns, and percussion has also threatened some musicians.

In 2004, musicians extracted a promise from the Opera Company of Brooklyn to never again use an advanced kind of synthesizer, called a virtual orchestra machine, in future productions.

A deliberate man with brushed-back white hair and a breast pocket packed with pens, Moog drove an aging Toyota painted with a snail, vines and a fish blowing bubbles.

``When I drive that thing around, people smile at me,'' he said. ``I really feel I'm enhancing the environment.''

He spent the early 1990s as a research professor of music at the University of North Carolina at Asheville before turning full-time to running his new instrument business, which was renamed Moog Music in 2002. The roster of customers includes Nine Inch Nails, Pearl Jam, Beck, Phish, Sonic Youth and Widespread Panic.

Moog is survived by his wife, Ileana; two daughters, a son, a stepdaughter, and his former wife, Shireleigh Moog.

A public memorial is scheduled for Wednesday in Asheville.

A three-day concert last weekend by the Athens, GA-based band Widespread Panic, popular among college students, saw 200 fans arrested on drug charges by law enforcement authorities at the Oak Mountain Amphitheatre in Pelham, AL. One woman died after apparently taking ecstasy, according to Pelham police; another "spreadhead," as the band's fans sometimes refer to themselves, committed suicide at a nearby motel. But the deaths were not the cause of the arrests, which were part of an operation planned in advance before the shows.

The arrests in Alabama are a harbinger of increased police drug enforcement activity at rock concert, raves and other music venues as the summer concert season looms, but concertgoers need not remain defenseless before the narcs. They can instead educate themselves about how to effectively exercise their constitutional rights and then do so, said Steven Silverman of the newly-formed organization Flex Your Rights (http://www.flexyourrights.org). Other activists have suggested proactive responses as well.

At Oak Mountain, the Alabama Alcoholic Beverage Commission and the Pelham Police Department carefully crafted "Operation Don't Panic" to target drug use and underage drinking at the concert. According to the Birmingham News, the operation "involved thousands of dollars, hundreds of worker hours and dozens of uniformed and plainclothes officers. It was one of the biggest ABC operations in recent memory," the newspaper noted.

Teams of undercover agents prowled the parking lots and concert grounds before and during the shows, attempting to purchase drugs from unwary vendors and to arrest distracted users. According to press accounts, the line-up of the arrested was a veritable cross-section of young, white America: a prison guard, a high school student, a criminal justice major, a Department of Energy employee, a construction worker, an itinerant vendor. Police reported seizing marijuana, cocaine, Oxycontin, nitrous oxide and ecstasy, among other proscribed substances.

"What they did to me was totally uncool," said Jason Bartlett, 30, a spreadhead and self-described ski bum from Colorado, who was arrested Friday and spent 20 hours in jail before a friend posted bail for his misdemeanor marijuana arrest. "We don't want to lose our scene. We are trying not to lose our vibe, but we are definitely scared."

Widespread Panic, a band that has taken up the mantle left first by the Grateful Dead and then by Phish as the band to follow across the country, was an obvious target -- or more precisely, its fans were. Widespread Panic shows saw 40 arrested at Valdosta State University in Georgia last October, 45 arrested in Charleston, SC, last November, and 53 arrested at Mississippi State University in April 2001.

But they aren't the only ones. With a bill in Congress targeting music event promoters for drug activity at their events (http://www.drcnet.org/wol/233.html#federalmethbill), the war on rave culture is already well underway, and with summer blockbuster tours such as Ozzfest and the Vans Warped Tour preparing to hit the road, rock and rave fans will be in the law enforcement crosshairs.

Many of them can avoid being arrested if they learn how to properly exercise their constitutional rights against unlawful searches and seizures, said Flex Your Rights' Silverman. "These folks need to understand that police officers see rock concerts as a target-rich environment," he told DRCNet. "People need to be in a self-preservation mode considering the zero-tolerance atmosphere in which we live," he said.

"Avoiding arrest on a drug charge is harm reduction," said Silverman. "We believe that the worst danger, especially with marijuana, is that of being arrested. If we can reduce the likelihood of people being arrested, we are doing harm reduction, from the perspective of both the individual and society at large," he explained.

"Do not do anything illegal in public," advised Silverman, who recently began taking his Flex Your Rights presentation before college student audiences. "Don't have contraband in plain view. If you are doing something illegal -- which we don't condone -- do it in the privacy of your own home."

But Silverman acknowledged that many people will possess and consume illicit drugs at concert events. In that case, Silverman said, if they encounter police, three rules should guide their conduct. "First, concertgoers do not have to talk to a police officer. If there is a problem, the question you always want to ask is, 'Officer, am I free to go? Or simply say 'I'm leaving' and then leave. If the officer prevents you from leaving, ask, 'Am I under arrest or being detained?' If not, you are free to leave. Do so. Immediately. And don't go back. Be courteous and non-confrontational, always call them sir or ma'am," he counseled. "We are not against the police, but we are trying to prevent police misconduct." That misconduct occurs any time police officers attempt to persuade or intimidate citizens into forfeiting their rights, Silverman said.

"Second -- and this is our single most important bit of advice -- never, ever consent to a warrantless search. Let me repeat: Never, ever consent to a warrantless search," Silverman emphasized. "If the police officer is asking your permission to search you, your car, or your property, that should be an alarm. He is telling you he does not have probable cause to search. He is saying, 'I can only search with your consent.' Do not consent. You have nothing to lose by not consenting and everything to lose if you do. Once you have consented to a search, you have waived your Fourth Amendment right to be free of unwarranted searches and seizures."

"Third," Silverman enumerated, "if you are arrested, keep your mouth shut. Don't think you can persuade the officer to let you go out of the kindness of his heart. Most likely, the officer will use anything you say to build a case against you. You have the right not to talk to the police without an attorney present -- flex that right," said Silverman.

Drug-using concertgoers need to pay attention to their surroundings, said Silverman. "You should plan for these places to be swarming with police and undercover officers," he said. "Watch out for them. And never give even a small amount of contraband to someone you don't know at a show," he said. "Your potential possession charge just turned into a possible felony distribution arrest."

Avoiding arrest is one thing. Helping others avoid arrest can also be done, often merely by alerting inattentive crowd members to the presence of police. The Birmingham News reported that at various points during police operations at Oak Mountain, operations were disrupted when undercover agents were loudly outed by cries of "narc" or "six-up" [an apparently distorted reference to "Hawaii Five-Oh"]. Spontaneous actions by the crowd at the 4th of July smoke-in in Washington, DC, last summer served a similar purpose. At that event, sharp-eyed and militant crowd members fanned out ahead of approaching police warning unwary tokers of the danger while other crowd members surrounded and loudly berated the woebegone -- and now quite ineffective -- narcs. The police gave up their forays into the crowd, instead limiting themselves to the event's fringes in hopes of picking off a young victim.

In some cases at smoke-ins, concerts, and political protests, people have "unarrested" others detained by police, physically wresting the detainee from police and allowing him or her to disappear into the safety of the crowd. This tactic, however, is rife with danger because it could lead to melees, police riots or felony assault arrests.

PROVO, Utah About 90 law enforcement officers from multiple agencies broke up what they said was a rave party on public and private property in the Diamond Fork area of Spanish Fork canyon.

Utah County sheriff's Sergeant Darren Gilbert says they made about 60 arrests last night for weapons offenses, driving under the influence, underage drinking, drug possession and distribution, resisting arrest, assault on a police officer and disorderly conduct.

Officers found cocaine, Ecstasy, marijuana, mushrooms, alcohol and large amounts of drug paraphernalia.

Gilbert says a 17-year-old West Jordan girl was found overdosed on Ecstasy, and was treated and released to her parents.

He said there were more than 250 people at the party. That is the number for which the county requires a permit, bond and county commission approval. Gilbert said the party did not have that approval.

Czechtek is open-air international and multicultural music festival with
12 year tradition. Not only different genres of music, but also videoart
and other art performances take place on this unique event of free
culture.

In all history of festival there were no significant damages or problems,
participants while leaving clean the land and take responsibility for
their action.

Contract with the owner of grass plain was clearly shown to police. There
is no indicaion that festival was in any way illegal, every aspect was
according to law of Czech Republic.

Although police stated throughout friday 29th several different reasons
for blockage of access to the place of festival, all were later shown as
lies or desinformation. The final reason for brute attack was "threat of
damaging the surrounding private pieces of land".

The presence of attending young people on surrounding land was caused by
police blockage of all roads and the police action was not taken against
this people, but against the people on legally borrowed property.

Woman from near willage, owner of adjoining land, said she had been woken
up by police friday morning, long before people began to arrive, taken to
police station and by false arguments encouraged to sign complaint.

Most of the people did not hear any appeal to leave the place, many of
them had drunk alcohol-containing beverages and could not go away with
cars, many of them believed that by taking part on legally organized
festival they cannot be targeted by police.

The first police action on saturday 30, 16:30PM took several hours and was
badly coordinated. On the place was 1000 policemen, water cannon, armoured
tank and low-flying helicopter.

The second night attack at 22PM was led with extreme brutality.

Police in heavy suits without identifying numbers refused to give
identifying information, information about their command and information
about first aid location.

Police used massive amounts of tear gas and desorientation grenades, in
many cases they threw tear gas granade into a car and did not let people
inside for long time get out, in other cases they broke car windows by
iron bars, threw grenade in and forced people to get out.

All people were beaten up, including teenage girls, which cried in pain.
Witnesses described attack on lone staing girl, who was pulled down by her
hair and kicked on the ground by four policemen.

There were hundreds of injuries, including cuts, bruises, burnings, broken
arms, shock. Many people were in shock still the next day afternoon with
red faces from tear gas.

Police intentionally damaged cars, electronic equipment and other
property. Attack was led with clear intention to cause injuries.

People were forced to go to near highway, which was closed several hours
and then the waiting trucks were allowed to go dangerously among the
desoriented people. Police confirmed death of young man attending the
festival. Reportedly he was killed by truck which left. The reason of this
death can be manipulated by police, no wittnesses were found to confirm
police statement.

Police brutality continued on scattered people till the sunday morning.

Czech state television Czech TV did not inform about the night attack,
it's news were not balanced, mainly repeating police statements. Czech TV
in its news also under estimated political value of call of freedom and
resignation of minister of interior on sunday's demonstration in Prague,
reporting briefly about techno-goers.

This is a call to foreing media to publish information about unlawful
police brutality and state of democracy and human rights in Czech
Republic.

PRAGUE, Aug 1 (Reuters) - The Czech president said on Monday a police crackdown which injured dozens at a rave was a grave mistake that split the country, adding that politicians may have overstepped the constitution in ordering it. Police used teargas, water cannon, stun grenades and batons on Saturday to end the party in a meadow near the village of Mlynec in southwestern Czech Republic, near the German border. Thousands of people demonstrated outside the Interior Ministry on Monday, protesting against what they called brutal police action. The office of President Vaclav Klaus, a former chief of the right-wing opposition Civic Democrats, said in a statement: "Those who approved the intervention bear full responsibility for damaging trust in the police and creating another split in our country." The police action was ordered by the local police chief and backed by Interior Minister Frantisek Bublan and Social Democrat Prime Minister Jiri Paroubek, who both said police acted to uphold the law. On Monday, Paroubek said in a statement he was sorry for the injuries on both sides, and that the action would be evaluated by the Interior Ministry's internal affairs division. The president's statement said the intervention was a "grave mistake" and demanded an explanation from the centre-left government. "The president will further follow the investigation of this case and demand an explanation from the government why there was such police intervention," it added. "It is also necessary to find out if some political steps before the police intervention, and during it, did not go beyond the framework of the constitution," the statement said. Klaus does not have much executive power but his views are taken seriously by many politicians. The interior minister was quoted by Czech media as saying he and Paroubek had planned how to respond to the party in advance. The party's organisers said they had a contract to use the meadow, but police said they were asked by owners of neighbouring land to halt the concert because their property was being damaged. TV footage showed some party-goers throwing bottles and rocks at the policemen.

As I looked back towards the crowd I saw a guy dressed in camoflauge walking by, toting an assault rifle. At this point, everyone was fully aware of what was going on . A few "troops" rushed the stage and cut the sound off and started yelling that everyone "get the **** out of here or go to jail". This is where it got really sticky.

No one resisted. That's for sure. They had police dogs raiding the crowd of people and I saw a dog signal out a guy who obviously had some drugs on him. The soldiers attacked the guy (4 of them on 1), and kicked him a few times in the ribs and had their knees in his back and sides. As they were cuffing him, there was about 1000 kids trying to leave in the backdrop, peacefully. Next thing I know, A can of ****ing TEAR GAS is launched into the crowd. People are running and screaming at this point. Girls are crying, guys are cussing... bad scene.

Now, this is all I saw with my own eyes, but I heard plenty of other accounts of the night. Now this isnt gossip I heard from some candy raver, these are instances cited straight out of the promoters mouth..

- One of the promoters friends (a very small female) was attacked by one of the police dogs. As she struggled to get away from it, the police tackled her. 3 grown men proceeded to KICK HER IN THE STOMACH.

- The police confiscated 3 video tapes in total. People were trying to document what was happening out there. The police saw one guy filming and ran after him, tackled him and his camera fell, and luckily.. his friend grabbed it and ran and got away. priceless footage. That's not all though. Out of 1,500 people, there's sure to be more footage.

- The police were rounding up the staff of the party and the main promoter went up to them with the permit for the show and said "here, I have the permit." The police then said, "no you don't" and ripped the permit out of his hand. Then, they put an assault rifle to his forehead and said "get the **** out of here right now."

Now.. let's get the facts straight here.

This event was 100% legal. They had every permit the city told them they needed. They had a 2 MILLION DOLLAR insurance policy for the event. They had liscenced security guards at the gates confiscating any alcohol or drugs found upon entry (yes, they searched every car on the way in). Oh, I suppose I should mention that they arrested all the security guards for possession.

Oh another interesting fact.. the police did not have a warrant. The owner of the land already has a lawsuit against the city for something similar. A few months ago, she rented her land for a party and the police raided that as well. And catch this, the police forced her to LEAVE HER OWN PERSONAL PROPERTY. That's right. They didnt arrest her, but made her leave her own property!!!

Don't get it twisted, this is all going down in probably THE most conservative state in the USA. And this is scary.. a gross violation of our civil liberties. The police wanted this party shut down, so they made it happen. Even though everything about this event was legal. The promoters spent over $ 20,000 on this show and did everything they had to to make it legit, only to have it taken away from them by a group of radical neo-con's with an agenda.

This was one of the scariest things I have ever witnessed in person. I can't even begin to describe how surreal it was. Helicopters, assault rifles, tear gas, camoflauge-wearing soldiers.... why? Was that really necessary?

This needs to be big news across the USofA. At least in our music scene (edm as a whole)... this could happen to any of us at any time. When we're losing the right to gather peacefully, we're also letting the police set a standard of what we can get away with. And I think that's BULLSHIT!

The system ****ed up last night... They broke up a party that was 100% legal and they physically hurt a lot of people there at the same time. The promoters already have 6 lawsuits ready to file with their lawyers and the ACLU is already involved.

I'm sure some pictures (and hopefully some video) will surface soon. I'll make sure to post them up here on 404, so you can see the Police State of America at work.

Utah County Sheriff's Office shuts down Rave Party in Spanish Fork Canyon.

During the summer of 2005 the Utah County Sheriff's Office has seen an increase in the number of large Rave parties that have occurred within Utah County. Approximately four weeks ago the Sheriff's Office became aware of another possible Rave party that was to occur somewhere in Utah County on August 20, 2005.

Tickets were sold through a Salt Lake vendor, Uprock, for $20.00. Tickets could be bought in advance and directions to the exact location of the Rave would be provided on the day of the event.

Utah County mass gathering ordinance prohibits the gathering of two hundred and fifty or more persons without a permit, bond, and Utah County Commission approval.

Research was conducted and no mass gathering permit had been obtained for this incident. However, a health department permit had been obtained and EMS personnel were contracted to be on scene for first aide.

From several previous experiences with Rave parties of this size, a large amount of drug use and underage consumption of alcohol occur. In addition reports of sexual assaults, overdoses, firearm violations, vehicle burglaries, and numerous individuals drive from the party under the influence of alcohol and or drugs.

Utah County Sheriff's Office Detectives interviewed several females that had attended a prior rave party in the Utah county area in the past month that had been sexual assaulted. These females stated that the combination of drugs and alcohol made them fear for their safety due to the groping and sexual assaults that occurred during the Rave party. In the last year alone one near fatal shooting was investigated by Utah County Sheriff's Office at a similar party.

Around noon on Saturday, August 20th, the Sheriff's office learned that the Rave Party was to take place in the Diamond Fork area located in Spanish Fork canyon at the Child's ranch. At that point it was again verified that the Utah County Commissioner's office had no knowledge of this nor had a permit been obtained.

Utah County Major Crimes was contacted to assist with undercover surveillance. Both local and state SWAT teams were called in to control the crowds ( Utah County Metro SWAT, Utah Department of Corrections out of Salt Lake and Gunnison, Department of Public Safety and their helicopter and Provo SWAT) approximately 90 law enforcement personnel combined.

At 9 pm the Rave party began and by 10 pm Major Crimes observed numerous illegal activities. Which included illegal use of drugs, distribution of drugs, and underage consumption of alcohol.

It was verified that more than 250 individuals were at the party, in violation or county statutes and by 11:30 pm law enforcement personnel moved in to curtail and disburse the party. During this process at least 60 arrests were made for weapons offenses, DUI, illegal underage consumption of alcohol, possession of marijuana, possession of cocaine, possession of methamphetamine, possession of ecstasy, distribution of ecstasy, resisting arrest, assault on a police officer, and disorderly conduct.

A safety sweep was conducted after the crowd was ordered to disburse and numerous narcotic items were located scattered on the ground which included: cocaine, ecstasy, marijuana, mushrooms, alcohol and large amounts of drug paraphernalia.

A 17 year old female from West Jordan, found by officers, had overdosed on ecstasy. She was treated and released to her parents.

Several local teenagers from Spanish Fork, Springville, Provo, and Payson were identified at the party by officers. As well as, numerous individuals out of the Salt Lake and Davis County area.

Parents need to be aware of the type of illegal activities that occurs at these type of gathering. Sexual assaults, rapes, overdoses, drugs, alcohol abuse, thefts, and firearms violations. The sale of drugs at these parties is so prevalent that at this particular Rave party drugs were offered to a local off duty emergency medical service personnel who were contracted to be there. In addition two security personnel hired by the promoter were arrested for possession of cocaine and ecstasy

Pharmacists' trial spotlights illicit use of the cough medicine

The abuse of a codeine-fortified cough syrup is so widespread among youths here that Houston has become nationally known in the rap culture as "the City of Syrup," a local researcher says.

Prosecutors will focus on the illegal distribution of the medication in the trial of six pharmacists, beginning today in a Houston federal court.

The pharmacists are the first to be prosecuted here on accusations of illegally dispensing the highly addictive prescription cough syrup codeine with promethazine.

The syrup has been used at least once by about 30 percent of teenagers in the Houston area, says Ron Peters, a professor at the University of Texas School of Public Health in Houston.

The figures from a yet-unpublished study based on a 2004 survey show an increase from Peters' earlier study, published in 2003, which concluded that 25 percent of teenagers at six alternative schools in Harris County had used the drug at least once. Peters did not name the schools.

About 10 percent of the teens in the earlier study said they had used the drug in the past 30 days.

"Anything over 4 percent in the last 30 days is a major drug problem," Peters said.

Those figures may be too conservative, said Troy Jefferson, who heads a drug treatment center for children and adolescents at Riverside General Hospital in Houston.

Jefferson said that, out of more than 5,000 teens treated at the clinic in the past seven years, as many as 35 percent had tried prescription cough syrup more than once.

Houston Police Department spokesman Lt. Robert Manzo said the cough syrup is "extremely popular," but he declined to comment about enforcement efforts.

A U.S. Drug Enforcement Administration spokesman declined to comment because of the pending trial, in which DEA agents are expected to testify.

One of Jefferson's patients, Austin Hewitt, 16, of Humble, said he and his friends mixed the syrup with Sprite or a variation of Sprite called Remix.

"It's pretty popular," Hewitt said, adding that the cough syrup is easy to get.

Jury selection begins today in the retrial of pharmacists John David Wiley III, 40, and Anthony Dwayne Essett, 38, co-owners of I-10 East Pharmaceutical Services; Otukayode Adeleke Otufale, 44, owner of Med Stop Pharmacy at 6440 Hillcroft; Isaac Simeon Achobe, 50, owner of American Choice Pharmacy at 8449 W. Bellfort; and Chicha Kazembe Combs, 29, and Andre Dion Brown, 37, co-owners of Mason Road Pharmacy in Katy.

U.S. District Judge David Hittner ordered the retrial after a jury in May was unable to reach a verdict.

The six are accused in a 170-count indictment of illegally dispensing thousands of gallons of the cough syrup and thousands of tablets of hydrocodone, a synthetic narcotic used as a painkiller. They also are charged with conspiracy and money laundering.

Hydrocodone, more often known by the brand name Vicodin, is a widely abused prescription drug that is always in demand on the illicit market, Peters said.

But the widespread use of codeine with promethazine is widely believed to have begun in Houston, along with the popularity of a type of rap music developed by local record producer D.J. Screw, who died in 2000 of an overdose of the drug he promoted in his songs.

The producer, whose real name was Robert Earl Davis Jr., developed a slowed-down form of rap called "screw" that extols the use of prescription cough syrup known on the street by such names as "syrup, lean, purple, syzurp, drank or purple jelly."

Now, Houston rappers such as nationally known Mike Jones lace their "screw" music with such lyrics as, "I keep that purple stuff in my cup," a reference to mixing cough syrup with soft drinks.

Peters said screw music and the abuse of the cough syrup has spread nationwide and into Canada. The popularity has given Houston nicknames such as "City of Syrup and City of Lean," he said.

"Now, Houston is setting the trend for the drug culture and it is being spread through rap," he said. "This is something that is a major problem throughout the United States."

Hewitt and K.D. Garner, 31, a University of Houston student who says "syrup" is widely used in his neighborhood, say the drug is most often made available by unscrupulous doctors.

Peters said users sometimes obtain a legitimate prescription by faking a serious cough.

The pharmacists' attorneys argued during the first trial that their clients didn't know they were filling fake prescriptions based on names lifted from a phone book by a doctor running a prescription mill.

Dr. Callie Hall Herpin, who pleaded guilty, testified during the first trial that another doctor showed her how to start a practice based on illegally dispensing controlled drugs.

Two office workers, who also pleaded guilty, admitted that they prepared prescriptions from computer-generated lists of phony patients that Herpin testified she signed without reading.

Highlights from the main stage were performances from Underworld, Ian Brown, Fatboy Slim, The White Stripes and Garbage who's set was delayed due to a freak storm, but they braved the rain and carried on regardless, much to the appreciation of the patiently waiting crowd. Standout performances in the dance area came courtesy of Carl Cox, Felix Da Housecat, Sasha and Sandy Rivera, with the climax being Darren Emerson on the final day as the sun was coming up.

5) MTV Fee Your Mind Arena
The Free Your Mind area came about because MTV wanted to provide an environment for the festivalgoers to openly discuss and learn about the issues surrounding human trafficking. The arena featured a series of film screenings and audio visual art presentations from young Serbian directors and artists. In a recent interview with Metal Maniacs magazine, EYEHATEGOD/SUPERJOINT RITUAL guitarist and DOWN drummer Jimmy Bower revealed that he is "sure we'll do another DOWN record. I've talked to Phil [Anselmo, DOWN/SUPERJOINT RITUAL/ex-PANTERA frontman] and everybody else. Everybody's expressed interest in wanting to do a DOWN record, so that's basically all it takes. Hopefully within the next year or two that can happen. DOWN records are fun. Phil's doing a lot better as far as handling [Dimebag's death]. It's been a big wake-up call for a lot of people over the the last five, six months. People are doing cool things with their lives; cool, positive things. Let's save metal!"

Apple Computer may be forced to pay royalties to Microsoft for every iPod it sells after it emerged that Bill Gates's software giant beat Steve Jobs' firm in the race to file a crucial patent on technology used in the popular portable music players. The total bill could run into hundreds of millions of dollars.

Although Apple introduced the iPod in November 2001, it did not file a provisional patent application until July 2002, and a full application was filed only in October that year.

In the meantime, Microsoft submitted an application in May 2002 to patent some key elements of music players, including song menu software.

Apple and Microsoft were two of several companies that developed portable players, but the iPod, with its sleek design and user-friendly controls, has dominated the market.

IPods make up three of every four portable music players bought in the US and account for almost one-third of Apple's sales. Piper Jaffray, a US analyst, believes Apple will sell 25 million iPods this year, bringing the total sold in the four years since its launch to 35 million.

In July, the US Patent and Trademark Office rejected Apple's application, saying some ideas were similar to an earlier application filed by a Microsoft employee, John Platt.

The dispute, which emerged this week on the closely watched website, Appleinsider.com, could lead to Apple having to pay a licence fee for the technology of up to $10 a machine.

David Kaefer, Microsoft's director of intellectual property licensing and business development, said: "In general, our policy is to allow others to license our patents so they can use our innovative methods in their products."

Apple has signalled it will resist the move. A spokeswoman said Apple would continue to try to get its patent recognised. The company could take the case to the patent office's appeals board. "Apple invented and publicly released the iPod interface before the Microsoft patent application was filed," it said in a statement.

The battle comes as Microsoft is squaring up against another competitor, Google. Microsoft last month launched a lawsuit against the search-engine giant, accusing it of poaching a top executive to head a new research laboratory in China. The Redmond, Washington-based company also sued the executive, Kai-Fu Lee.

NEW ORLEANS — Louisiana's new law regulating the sale of Sudafed and similar cold medicines takes effect Aug. 15 and pharmacists who will have to enforce it see it as just another rock on an existing mountain of regulation.

Thirty-three states restrict the amount of ephedrine or pseudoephedrine pills people can buy and sell because the drug is a major ingredient for illegal methamphetamine labs, according to the National Association of Chain Drug Stores.

A stricter federal bill also is in the works for such medicines, which include Procter & Gamble Co.'s Nyquil as well as Pfizer Inc.'s Sudafed. And drug companies are changing their ingredients to eliminate those which can be used for meth.

Louisiana's new law also requires stores to limit boxes on their display shelves, to keep those shelves in easy eyeshot or keep a videocamera on them, and to check customers' photo IDs and make them sign a receipt or log book.

"We don't sell that much, and don't see that it's that much of a problem," said Leonard Sullivan of Sullivan's Pharmacy in Zachary.

It might be a burden on chain drug stores, which sell more of everything, said Gerlando "Gerry" Messina, owner of Messina's Pharmacy in Baton Rouge.

It's overall recordkeeping, for insurance companies and physicians as well as the state, that's the real problem, Sullivan said. "With the consulting and all the record keeping, it pretty much gets to the point that it makes our life miserable," he said. "They keep cutting our fees ... and they keep demanding that we do more."

He followed news reports about the law while it was still in the Legislature.

Randy Carr of Carr Drugs on New Orleans' West Bank and other independent pharmacists also said they didn't sell large amounts of the drugs.

Still, Carr said he isn't looking forward to the new record-keeping. "It's going to be a pain," he said. "People are not going to want to have to do one more thing – sign a log book, show your ID."

The records must be kept only for 15 days. "Then what?" he asked. "Are we supposed to shred it? File it? Are we responsibile to do the cross-referencing? It's going to be interesting to see how it's all interpreted."

He hadn't heard about that requirement for logbooks or signed receipts.

The state Board of Pharmacy plans to have mailed bulletins reach pharmacists statewide by Aug. 12, the Friday before the regulations go into effect. Asked if that was short notice, executive director Malcolm Broussard said, "The public is on notice whenever the Legislature passes a law."

Some chains got word out to their franchises considerably earlier. "Our stores were all notified of that in mid-July," said Mike DeAngelis, spokesman for CVS Corp. in Woonsocket, R.I.

He said CVS already required its stores to keep all pills or liquids in which ephedrine or pseudoephedrine was the only active ingredient behind the druggist's counter, and limited sales to 9 grams per customer.

Louisiana is moving to an even stricter limit: 9 grams per customer, per month.

And that's not the strictest state law. Alabama and Minnesota restrict sales or purchases to two packages, or 6 grams. The state of Washington allows only pharmacists or pharmacy employes or practitioners to sell products in which pseudoephedrine or ephedrine is the only active ingredient, and they have to keep their log books for two years.

In Oregon, which already had a 9-gram limit, a bill requiring a physician's prescription for ephedrine or pseudoephedrine has been sent to the governor, who supports it. It will take effect next July.

When it returns from its recess, the U.S. Senate is likely to vote on a federal bill that is stricter than Louisiana's. It would limit customers to 7.5 grams – about 250 30-milligram pills – in 30 days, require customers to sign a log book, and use computer tracking to keep people from going store-to-store.

And legal drug makers are changing many of their formulas. Pfizer plans to be using phenylephrine, rather than pseudoephedrine, in up to half of its products by January. Leiner Health Products, which supplies generic cold and allergy drugs to retail chains such as Costco, Target, Walgreens and Wal-Mart, began shipping new products containing phenylephrine in June.

Every Louisiana pharmacist interviewed agreed that something must be done to keep the ingredients out of the hands of people who want to misuse them to make meth.

"We need to keep the drugs off the street. No question," Carr said. "The problem is, is everybody else doing this? Is Canada doing this? Is Mexico doing this? How eay is it going to be to get the chemicals from other places?"

It took less than a month after the official release of Danny Howells GU027:Miami for the Global Undergound crew to announce their next installment of the successful series Nick Warren GU028:Shanghai. Fittingly, one month after our in-depth Danny Howell’s interview RA can now announce not only the track listing for the album, which is based on Warren's set at Fenwick The Dock in the Shanghai metropolis in February, but also his upcoming Northern Hemisphere Summer tour dates.

The entertaining Warren has always had a huge legion of followers from around the world as the former Massive Attack support DJ, one half of U.K. production gods Way Out West and as a solo DJ so its fitting that this release encompasses a selection from 13 different nationalities. Many of these tracks have never been released and Nick was clearly happy to push the underground sounds:
"I wanted to showcase as many young producers as I could. Find tracks that were unsigned and give them a platform. Record labels don’t give young producers the time to go and make an album, so it’s hard for them to get their music heard."
A mix which dips in and out of everything from indie-rock influenced vocal tracks to sweetly melodic deep house to raging acid.
